Vigour Media Wellbeing Hub Terms of Use
Effective date: 26/8/2026
1. About these Terms
These Terms of Use (Terms) govern your access to and use of the Vigour Media Wellbeing Hub, including its content, health calculators, workouts, recipes, musical interludes, Wellbeing Navigator and links to third-party services (collectively, the Hub).
The Hub is operated by Black Sparrow Group Pty Ltd trading as Vigour Media (ABN 57 625 054 720) (Vigour Media, we, us or our).
By accessing or using the Hub, you agree to these Terms and acknowledge our Privacy Policy and any additional notices displayed in connection with a particular feature on this site or the Vigour Media website. If you do not agree to these Terms, you must not use the Hub.
Your employer, educational institution, membership organisation or another organisation may arrange or sponsor your access to the Hub (Sponsoring Organisation). A Sponsoring Organisation does not become a party to these Terms merely because it provides access to the Hub.
2. Changes to these Terms
We may update these Terms from time to time. Updated Terms will be made available through the Hub and will identify their effective date. Where a change materially affects users' rights or obligations, we will take reasonable steps to provide notice before the change takes effect. Changes will not operate retrospectively unless required by law.
Your continued use of the Hub after updated Terms take effect constitutes your acceptance of those Terms. If you do not agree to an update, you must stop using the Hub.
3. Eligibility and access
You may use the Hub only if you are legally capable of agreeing to these Terms. If you are under 18, you may use the Hub only with the involvement and permission of a parent or legal guardian where required by law and where your access has been authorised by us or your Sponsoring Organisation.
Access to some features may depend on your Sponsoring Organisation's subscription, your location, eligibility requirements or third-party service availability. Access is personal to you and may not be transferred to another person.
We may change, withdraw, suspend or restrict a feature or a user's access where reasonably necessary for maintenance, security, legal or regulatory compliance, suspected misuse, expiry or termination of a relevant subscription, or the protection of users or third parties. Where reasonably practicable, we will provide notice of a material suspension or withdrawal.
4. Accounts and security
If an account, password, access code or other credential is issued to you, you must:
• keep it secure and confidential;
• not share it with another person or permit unauthorised access;
• provide accurate information where information is required; and
• notify us promptly if you know or reasonably suspect that it has been lost, disclosed or misused.
You are responsible for activity conducted through your account to the extent that it results from your failure to take reasonable steps to protect your credentials. This does not make you responsible for activity caused by our breach, negligence or security failure.
5. General information only
The Hub provides general educational and wellbeing information. Content available through the Hub:
• does not take account of your complete circumstances, medical history or individual needs;
• is not medical, psychological, nutritional, financial, legal or other professional advice;
• is not intended to diagnose, treat, cure or prevent any disease, injury or condition; and
• is not a substitute for advice, diagnosis or treatment from an appropriately qualified professional.
Do not delay seeking professional advice, disregard professional advice, or commence, change or discontinue medication, treatment, diet, exercise or another course of action because of information available through the Hub.
Although we take reasonable steps to draw on credible sources and review content at the time of publication, health and wellbeing knowledge can change. To the maximum extent permitted by law, we do not guarantee that all content is complete, current, suitable for your circumstances or free from error. You should verify information that is important to a health, safety, financial or other significant decision.
Content may include the views or recommendations of authors, sponsors, contributors or other third parties. Those views do not necessarily represent our views. The appearance of a product, service or contributor does not, by itself, constitute our endorsement.
6. Emergencies and urgent assistance
The Hub, including the Wellbeing Navigator, contact forms, health calculators, EAP links and telehealth links, is not an emergency, crisis-response or medical-monitoring service. It is not continuously monitored and must not be used where urgent assistance is required.
If you or another person is in immediate danger or may require urgent medical attention, contact the emergency service for your location. In Australia, call Triple Zero (000). If you are outside Australia, contact the emergency service available in your location.
Submitting a question, completing a calculator or interacting with the Wellbeing Navigator does not alert emergency services, Vigour Media, your Sponsoring Organisation, an EAP provider or a healthcare professional.
7. Wellbeing Navigator
The Hub may include an artificial intelligence-enabled Wellbeing Navigator designed to help you locate and understand general health and wellbeing information and approved resources.
The Wellbeing Navigator is an AI system. AI can make mistakes. Its responses may be inaccurate, incomplete, outdated, unsuitable or inconsistent, even when they appear confident or authoritative. You must independently verify information before relying on it.
The Wellbeing Navigator:
• is not a diagnostic tool;
• does not provide medical, psychological, counselling, nutritional, financial, legal or other professional advice;
• does not replace a doctor, psychologist, counsellor, pharmacist, financial adviser or other appropriately qualified professional;
• does not create a practitioner-patient, therapist-client, fiduciary or other professional relationship;
• cannot conduct a physical examination, confirm a diagnosis, prescribe medication or develop a personalised treatment plan; and
• is not an emergency or crisis-support service.
Do not use a response from the Wellbeing Navigator to make a diagnosis or to commence, alter or discontinue medication, treatment or professional care. If you have symptoms, a health concern or questions about treatment, seek advice from an appropriately qualified healthcare professional.
The Wellbeing Navigator may direct you to third-party resources or services. Those resources and services remain subject to their own terms and privacy practices, and their inclusion does not necessarily constitute an endorsement.
Information you enter into the Wellbeing Navigator may be processed by us and our technology service providers to generate and deliver a response, maintain security and operate the feature, as described in our Privacy Policy and any collection notice displayed when you use it. Do not enter another person's personal or health information unless you are authorised to do so. Do not enter information that is unnecessary for your enquiry.
Unless expressly stated otherwise, the Wellbeing Navigator does not remember your complete health history and cannot know whether information you provide is accurate or complete. You remain responsible for deciding whether to act on general information and for obtaining professional advice where appropriate.
8. Health calculators and self-assessment tools
Health calculators, questionnaires, scores and self-assessment tools available through the Hub provide general estimates based only on the information entered and assumptions underlying the relevant tool. Results may not account for your complete medical history, individual circumstances, measurement error or other clinically relevant factors.
A result is not a diagnosis, medical assessment or recommendation for treatment. Do not use a result to commence, change or discontinue medication, treatment, diet or exercise without appropriate professional advice. Seek medical advice if you have concerns about a result or your health.
Information entered into a calculator or assessment will be handled as described in our Privacy Policy and any collection notice displayed with the tool.
9. Exercise and physical activity
Before beginning a workout or fitness program, consider whether it is appropriate for your health, fitness, mobility and experience. Consult your general practitioner or another appropriately qualified healthcare professional before participating if you have a health condition, injury, are pregnant, have been inactive, are unsure whether exercise is suitable, or have been advised to restrict physical activity.
Exercise in a safe environment, use suitable equipment, ensure that you have adequate space, follow the instructions provided and select an intensity appropriate to your ability. Where appropriate, complete a suitable warm-up and cool-down.
Stop exercising immediately if you experience pain, chest discomfort, severe or unusual shortness of breath, dizziness, faintness or another concerning symptom. Seek urgent medical assistance where appropriate.
You are responsible for deciding, with professional advice where appropriate, whether an activity is suitable for you. Nothing in this section excludes any responsibility or legal right that cannot lawfully be excluded.
10. Recipes and nutrition content
Recipes and nutrition content are provided for general information and inspiration. You are responsible for checking ingredients, preparation methods, serving sizes and nutritional suitability for your individual circumstances.
If you have an allergy, intolerance, medical condition, dietary requirement or concern about food safety, check product labels and seek appropriate professional advice. We cannot guarantee that recipes or linked products are free from allergens or suitable for every dietary or medical requirement.
11. Employee Assistance Program
The Hub may provide access or links to an Employee Assistance Program (EAP) supplied by an independent provider. Vigour Media does not provide counselling, psychological, medical, crisis-response or EAP services and is not responsible for assessing whether an EAP service is suitable for your circumstances.
Your eligibility for and use of an EAP is governed by the EAP provider's terms, privacy policy, clinical arrangements and any applicable arrangement with your Sponsoring Organisation. The EAP provider is responsible for the services it supplies and for the conduct of its personnel.
Unless expressly disclosed otherwise, Vigour Media does not receive or have access to the content of your counselling sessions or private communications with an EAP provider. Contact the EAP provider directly with questions about confidentiality, eligibility, appointments, records, fees or available services.
12. Telehealth services
The Hub may contain links that enable you to access telehealth services supplied by independent third-party healthcare providers (Health Providers). Vigour Media does not provide healthcare services, select your treating practitioner, control clinical decisions or enter into the practitioner-patient relationship.
Telehealth services are governed by the relevant Health Provider's eligibility requirements, terms, fees, consent processes and privacy policy. The Health Provider is responsible for determining whether telehealth is clinically appropriate and whether an in-person examination, diagnostic testing, emergency care or referral is required.
Vigour Media does not guarantee the availability, suitability, outcome or quality of a Health Provider's services. To the extent permitted by law, we are not responsible for clinical advice, diagnosis, treatment or other services supplied independently by a Health Provider.
Unless expressly disclosed otherwise, Vigour Media does not receive or have access to the clinical content of your telehealth consultation or the medical records maintained by a Health Provider. Contact the Health Provider directly with questions about its services, records, privacy practices or complaints process.
13. Sponsoring Organisations and usage information
Your Sponsoring Organisation may receive aggregated or de-identified information about use of the Hub where permitted by law and described in our Privacy Policy. This may include general information about engagement with Hub sections or resources.
Unless expressly disclosed to you, authorised by you or required or permitted by law, we do not provide a Sponsoring Organisation with:
• the content of your EAP or telehealth consultations;
• the content of your private communications with independent healthcare providers;
• information you enter into health calculators or self-assessment tools in a form that identifies you; or
• the content of your Wellbeing Navigator conversations in a form that identifies you.
Further information about the collection, use and disclosure of personal information is provided in our Privacy Policy and any feature-specific collection notice.
14. Privacy
Our Privacy Policy explains how we collect, hold, use and disclose personal information in connection with the Hub, including account, technical and usage information and information submitted through interactive features. By using the Hub, you acknowledge that personal information will be handled as described in that policy and any collection notice presented to you.
You should review the privacy policy and terms of each third-party service before providing information to it. Third-party providers may collect information directly from you under their own privacy practices.
15. Cookies and tracking technologies
The Hub may use cookies and similar technologies to operate its features, remember settings, understand how the Hub is used and, where applicable, support communications or advertising. Further information about the cookies and technologies we use, their providers, purposes and duration will be provided in our Cookie Notice or cookie preference centre.
When you first visit the Hub, you will be given a clear opportunity to manage your cookie preferences. You may:
• accept all cookies;
• reject all non-essential cookies; or
• choose which categories of non-essential cookies you wish to allow.
Strictly necessary cookies may operate without your consent where they are required to provide a service you request, maintain security, remember privacy choices or enable essential Hub functions. They cannot be disabled through the cookie preference centre, although your browser may allow you to block them. Blocking strictly necessary cookies may prevent parts of the Hub from functioning correctly.
Where consent is required by applicable law, analytics, personalisation, advertising and other non-essential cookies will not be placed or activated unless and until you choose to allow them. Refusing optional cookies will not prevent you from accessing the core functions of the Hub, although some optional features may be unavailable or less personalised.
You may review or change your cookie choices at any time through the Cookie Preferences link available in the Hub. Withdrawing consent will not affect processing that occurred lawfully before your preferences were changed. You may also be able to control cookies using your browser or device settings.
Your cookie preferences apply to the browser and device on which they are selected. You may need to set them again if you use another device or browser, clear your cookies, or use a private browsing session.
16. Acceptable use
You must not:
• use the Hub unlawfully, fraudulently or in a way that infringes another person's rights;
• share access credentials or attempt to gain unauthorised access to the Hub, another account or any connected system;
• introduce malware, malicious code or harmful material;
• interfere with the security, integrity, availability or operation of the Hub;
• scrape, harvest, systematically download, data-mine or use automated means to extract Hub content or data without our prior written consent;
• reverse engineer, decompile or attempt to discover source code, models, prompts or security controls, except to the extent such restriction is prohibited by law;
• impersonate another person or misrepresent your identity or authority;
• enter, upload or disclose another person's personal or health information without authority;
• use the Hub or its content to train, develop or improve an artificial intelligence or machine-learning system without our prior written consent; or
• use the Hub in a manner that could harm another person or expose us or another person to legal liability.
17. Intellectual property
The Hub and its content, design, branding, software and materials are owned by or licensed to us and are protected by intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Hub and its content for your personal, non-commercial health and wellbeing purposes, subject to these Terms.
Except as permitted by law or these Terms, you must not copy, reproduce, adapt, modify, publish, communicate, distribute, sell, license, store or commercially exploit Hub content without our prior express written permission. Nothing in these Terms transfers intellectual property rights to you or restricts any lawful fair dealing or other use that cannot be excluded.
Third-party trade marks, content and materials remain the property of their respective owners.
18. Third-party websites, services and advertising
The Hub may contain links, integrations, advertising or references to websites, products and services operated by third parties. Third-party services do not form part of the Hub and are not controlled by us.
We take reasonable care when selecting resources, but do not guarantee the accuracy, currency, security, availability or suitability of third-party content or services. A link, advertisement or reference does not necessarily mean that we endorse the relevant provider, product, service or claims.
When you leave the Hub or use a third-party service, that third party's terms and privacy policy apply. You are responsible for deciding whether a third-party service is suitable for you.
19. External activities and offers
The Hub may promote functions, events, competitions, benefits, discounts, products, services or other activities conducted by us or third parties (External Activities). Additional eligibility rules, terms and privacy notices may apply.
Where an External Activity is supplied by a third party, that third party is responsible for conducting it and supplying any associated product or service. To the extent permitted by law, we are not responsible for the acts or omissions of an independent third-party provider.
20. Availability and security
We take reasonable steps to maintain the Hub, but do not guarantee that it will always be available, uninterrupted, secure or free from defects, malicious code or compatibility issues. Maintenance, telecommunications failures, cyber incidents and matters beyond our reasonable control may affect availability.
You should use current security software and take reasonable precautions to protect your device, credentials and data. We are not responsible for damage caused solely by your failure to take reasonable security precautions, but nothing in these Terms excludes liability that cannot lawfully be excluded.
21. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or other protection under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.
Where our liability can lawfully be limited, it is limited only to the extent permitted by law.
22. Disclaimers and limitation of liability
Subject to section 21 and to the maximum extent permitted by law:
• the Hub is supplied on an "as available" basis;
• we are not liable for loss arising solely from reliance on general information provided through the Hub, use contrary to these Terms, or the acts or omissions of independent third-party providers;
• we are not liable for loss that was not reasonably foreseeable at the time you agreed to these Terms; and
• we do not exclude or limit liability arising from our fraud, wilful misconduct or any other liability that cannot lawfully be excluded or limited.
Nothing in these Terms makes us responsible for clinical advice, diagnosis, treatment, counselling, EAP services, telehealth services, products or other services independently supplied by a third party.
Where loss is caused by both our conduct and your conduct, or the conduct of another person, our liability will be reduced to the extent permitted by law to reflect each party's contribution to the loss.
23. Your responsibility for loss
You are responsible for loss reasonably suffered by us as a direct result of your material breach of these Terms, unlawful conduct or infringement of another person's rights. Your responsibility will be reduced to the extent that our acts or omissions contributed to the loss.
24. Complaints and reporting concerns
If you believe Hub content is inaccurate, unsafe, unlawful or infringes your rights, or if you have a complaint about the Hub, contact us using the details in section 30. Please provide enough information for us to understand and assess the concern.
Complaints concerning clinical care, counselling, an EAP, telehealth or another third-party service should generally be directed to the provider responsible for that service. This does not affect any right you may have to contact a regulator or other authority.
25. Assignment
We may transfer or subcontract our rights or obligations under these Terms where doing so does not materially reduce your rights and is permitted by law. You may not transfer your rights or obligations under these Terms without our prior written consent, except where the law permits otherwise.
26. No agency
No partnership, joint venture, employment, fiduciary or agency relationship is created between you and us merely because you access or use the Hub.
27. Severability
If a provision of these Terms is found to be invalid or unenforceable, it will be read down to the extent necessary to make it valid and enforceable. If it cannot be read down, it will be severed. The remaining provisions will continue to apply.
28. Entire agreement
These Terms, our Privacy Policy and any additional terms expressly applying to a Hub feature constitute the agreement between you and us concerning your use of the Hub. They do not replace the separate terms applying between you and an independent third-party provider or between us and a Sponsoring Organisation.
29. Governing law and jurisdiction
These Terms are governed by the laws in force in Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and courts competent to hear appeals from them.
Nothing in this section prevents you from exercising rights available under a law that applies to you and cannot be excluded by agreement.
